I am just starting to look into a CV joint setup, but have been told it would work. So at this time I do not have the information to comment on your observation. I know that in short wheel base Jeeps they quite often use CV joints in lifted applications. I know in those cases that the pinion and the drivew line are at different angle. Now I would suspect that the pinion shaft and the transfer case output shafts are close to being on the same plane which may be the more important factor.
