Mentions brakes that are supposed to be independent from the tow vehicle, never enforced, and I suppose can mean the break-away lock? If this is a problem, the manufacturers liabilities would end surge sales in a heart beat.

My doubts about electric brakes are that they make it easier to jack knife the rig when the trailer brakes lock up. The skidding trailer tires have less braking than the tow car, and the trailer tries to pass the tow car. I don't know if this happens automatically, but I sure can see it happen if the driver uses the manual actuator. Lock up the trailer on wet stuff, it starts swerving all over with out any feedback via the seat of the drivers pants.

Where as a trailer equipped with surge brakes will have the brakes forcibly released as the tow car drags the trailer forward.
