Small claims courts in different jurisdictions have different jurisdictional limits. In CT you can go to small claims on a controversy involving $5k. If I understood this correctly the amount in dispute is not 5k but rather what will be lost is 5k. If NY is anything like CT, the jurisdictional limit for small claims is probably significantly more then 2500. This is coming from a liar, oops lawyer. At leaset I am not a used car salesman or a home improvement contractor. I only say this to illustrate that all professions have unscrupulous people involved.
