Steve,
First, the trailer may not have brakes at all. Look on the inside of the wheels near the axle tube. If you have brake drums, you have brakes. If you have a pair of wires coming out of the brake drum area (again on the inside) you have electric brakes and DO NEED a brake controller in the truck. If you don't have a brake drum on any of the wheels, you don't have brakes on the trailer and don't need a brake controller.
Most states, (not all) don't require brakes on trailers under 3,000 lb GVWR.
