Like others have said, you have to jump through Ebays hoops.
They'll want you to file a non paying bidder complaint first. They drag this stuff out like an eviction with waiting periods till you can take the next step. With your situation of them saying he's paid, you'll have to talk directly to someone. They've change there "live" help as you used to be able to go back and forth online. Now, you wait in line and you can have them call you and talk directly.
For the most part with Ebay and Paypal, down payments are a joke. My guess is they will refund the guys down payment and give him an "almighty non paying bidder strike" Get a few of those and they kick you off, or in another words, set up another account to do it again.
Like a lot of things anymore the down payment isn't what it was intended to be. Old schioolers like us believe it to be a forfeit if you back out. New school thinks it's a means to get someone to hold item till buyer can see if it's allright with spouse or if they can get the funds lined up. If they don't buy the item they feel the seller should refund since they didn't get the item. VERY twisted from what it IS supposed to represent.
I for one would be interested on what EBAY/Paypal does here. Let us know the outcome if possible. Kevin
