Ebay may be going overboard.
If the material is "public domain" as defined in ITAR, then it is specifically exempted from the export restrictions.

The regs are there. Definitions in Part 120 and include 120.11 which covers "public domain", which exempts material commonly available "(1) Through sales at newsstands and bookstores".
