I got the impression you received this in Idaho. Yes, Washington is among many where it's a primary offense. I THINK (not sure) in Idaho it's still a secondary offense. The only time I ever got warned about not wearing mine was when I got stopped because one of the lights on my boat trailer wasn't working. Then it was just a warning.
