I agree, that looks typical for a bent bolt failure. Also as you hinted I would expect more failures due to a design fault where the bolt has to do all the work in a way it was never meant to do. To get the best from a clamp bolt, it should be supported by the surrounding material, where in this application it's supported by steel one side and rubber on the other. You could try grade 8 cap heads with heavy spring washers under - this will allow a different weight distribution on the bolts and a smaller surface contact area to relieve some of the bending moment.
