Your next step under NY Law is entirely dependant upon the writing signed by both parties at the time of agreement of sale.
No signed agreement puts the deal into a lay away sale, and you may find even his deposit is refundable along with all other monies paid so far. I sure hope since you are still in posession of the truck all monies paid are on deposit in a dedicated bank account.
