ACLU is probably going after it as a 1st amendment division of church and state issue not as an historical artifact.
Arguement could be made as you state, that it now falls under the antiquities act and since it is the only remaining artifact from a WW1 veterans retreat it is a cultural icon.
Under ACLU logic, should we tear down the Alamo because it was a mission?
