Being a danger to you at work, versus using illegal drugs. You don't mind a guy getting drunk and hung over at work, so long as he sobers up by monday, since beer is legal, but if he smoked pot while he was on vacation 2 weeks ago, you seem to think he's a danger to you at work just because pot is illegal, and it stays in his system long enough to make him fail a whiz quiz long after he smoked it.

I don't use any recreational drugs myself, not even booze or tobacco, because I don't see as how they'd do me any good, but we have some laws in this country that are just plain wrong, and I'm not one of those people who thinks that just because somebody made a law against something once, I have to agree with it. People should be judged for their actions that harm others, and that's it. For every drunk driver I see on the road, I see drivers that simply aren't paying attention, change lanes without looking, don't yield the right of way, steer with their knee while they're gesturing to their passenger, etc. I'll be equally dead if somebody runs into me because they were drunk or because they were text messaging on their cell phone. I'd much rather have them stay home and shoot themselves full of heroin and meth than get out on the highway clean and sober but not paying a bit of attention to what's going on around them.

The workplace safety issue is important, but I don't see how whiz quizzes have much to do with it. If a company is allowed to fire or discipline any employee for poor job performance, it doesn't really matter why their performance is poor. If they show up at work stoned or drunk, of course you can them. But also, if they're just plain careless or arrogant and don't follow the safety rules, that's every bit as dangerous even if they're clean and sober.

There's also the very real issue that in a lot of industries, in today's tight job market, if you make everybody pass a whiz quiz, you won't have a crew. Try putting together an oil drilling crew or a high-voltage power-line crew without any tweakers, pot smokers, or alcoholics on it.
