Tell them they have one chance to settle the claim directly with you before you retain a lawyer. After you retain one they will have to deal only with him and you will instruct him to start action on your claim including your personal injury. (You did say your neck hurt the next day) What they are doing is pretty standard insurance BS and they won't settle until they understand it is going to cost them more to continue to delay. With the police report on your side, just ask them if they want their driver to try to refute the facts the police office found. I've had 4 or 5 claims like this over the years (100% the other drivers fault) it its the same story every singe time.
