To eliminate the advantage a seller can have in these situations along with the subjective BS insist on measurements. If it's a dealer they have no excuse to not have a tread depth gauge which reads in 32cnds of an inch. If no gauge everybody has a penny. Have them stick the penny into the tread at the most worn out area on each tire's face. That's easy to find. Put the penny in on edge with Lincolns head down (uspside down). They can relay this info to you on each tire. Most commercial tires start out with about 15/32s depth but they do vary depending on tire so you have to do your home work on that. If it only goes in to the top of his head or even his hair line it's a bald tire no matter how much tread is left in other areas of the face of the tire. After you get the results measure your own penny and you have it. If the tires get to you different than reported it is fraud. Then call E-bay. Good Luck Lyle
