Eminent Domain is only legal when the land is used "for the public good". Otherwise it constitutes a "taking" and is unconstitutional. Agencies and local governments have taken extreme liberties with the eminent domain concept and the courts are starting to rule against such takings when the land is not used for public projects, but instead given to a local developer for trades or in exchange for low income housing or other such borderline "public good" projects. However all that takes knowing a good politicaly active legal group, or having enough funds to hire a good attorney (is 'good attorney' an oxymoron?)
