Even if you did get the frame repaired as you descrbe, safety is a major concern. What if you get in an accident? With a passenger? Now liability is a concern. If you repaired the frame on your own, it proves that (1) the frame was bad, (2) you knew it, and (3) tried to fix it yourself. I smell a lawyer and a lawsuit. I would change the frame and weld on some plates where the old one rusted, for further off-road strength and rust protection.
