I have posted the text of the applicable section on the M-37 Forum. Suffice to say, this section requires demilitarization of anything which meets the following criteria:

1. It is a weapon, or

2. It is uniquly military.

If either 1 or 2 are met, then the DOD may require demilitarization if:

1. The item appears on the munitions list, or

2. The DOD regards the item as being a danger to public welfare unless demilitarized.

You will note that most of the definitions are soley up to the DOD. The DOD would decide what is uniquly military, and the DOD would decide if an item is a danger to public welfare.

This bill requires demilitarization of the item if the DOD ever owned it. So it doesn't matter if the item has been in civilian hands for fifty years, it would still have to be demilitarized.

What constitutes demilitarization is also something which, according to this section, the DOD decides.

This bill is starting to be opposed by some firearms owners, some vintage vehicle owners, and it really has the attention of the vintage aircraft owners in a major way. In the wake of the recent disaster this bill, which was introduced the day after the World Trade Center attack, is likely to sail through, so if you don't like it you better contact your Senators and Congressmen immediately.
