Nick - first sorry to hear and good luck. As others have said this too will pass in time. I hope your thought process is correct with respect to the $35K - but hope is not an effective strategy. Unless you get her to agree to this settlement in mediation, you could still be at risk of paying alimony. Not knowing how/when the money was "borrowed" from your 401K you could get stuck just as if she ran up your credit cards. I sincerely hope that is not the case and you are able to trade the missing money as your lump sum alimony.
