I my opinion the whole thing is pretty ironic.
What is the purpose of a down payment? You are basically saying you do NOT trust the other party and they need to show their seriousness by putting some money up front. Now we've come to the point of returning that jester of honesty because the person STILL doesn't want to keep their word.
Don't get me wrong, I too have returned down payments several times when ACTUAL situations arose for them. It just varies from case to case.
Here's one thing I have done I've offered the person who wants the down payment back:
You find someone else to buy the item for the same agreed price and when the deal is complete and they say that YOU told them about it, I'll return the down payment.
You guessed it, no takers on that yet.
