It depends on the person's particular state of residences laws.
Many states are like mine (Maryland). You have to have a title to get a new title, a Catch-22.
I found this out when I bought an M-37 across the river in Virginia. The title was "lost" and the Virginia DMV could not cross reference the VIN in their records; it had been last registered before this data was getting stored or something.
Maryland said I would in effect have to hire a lawyer to get a Writ of Mendamus to get the title.
Broadway was able to legally get me a title and so I solved the problem for about $150 (the price then). This is because in Alabama (where Broadway is) they don't title antique vehicles, they have a letter of registration. In our Republic, other states have to honor the laws of another state in such matters with transfer of a vehicle's title and the like. So, when I returned to the DMV with the Alabama registration on my vehicle, all of a sudden there was absolutely no problem, and I got my Maryland title pronto.
I would advise anyone buying a vehicle or trailer to find out first how their state handles antique vehicles from a title standpoint, or in the case of a trailer if any title is necessary.
On the Broadway website they list which states they can legally provide a vehicle title for and which states they cannot.
Recent changes in the law make this even more important than before. For example, today I could not have titled the M37 even with Broadway's help as with new regs the vehicles must pass a safety inspection. So, non-running or otherwise resto cases would "flunk". So, it is getting harder and harder to title such vehicles you might find in a "bone-yard" if they do not have a title.
