If the dealer is an independent shop that does small engine repair, I agree with you. If he bought it from a big-box store, all they are going to be able to do is give him his money back or swap it for another one. I have noticed that snow-blowers, like generators, often "surge" or "hunt" when unloaded. Lawn mowers don't seem to have the problem, probably because the wind resistance of the blade is enough to put a load on them all the time. I think it's worth looking at the governor linkage and seeing if there's a mechanism as I described for adjusting the gain of the system. I've seen it explained in some of the better service manuals.

Warranty or no warranty, sometimes it's easier and better to just fix the thing yourself than mess with the return/exchange process and maybe get another one that has the same problem because they don't bother setting them up correctly in the factory.
