I know you can stake claims on any crown land in Canada, including parks (in the US, parks are "withdrawn from mineral location") but other public lands aren't) but surely that doesn't mean you can stake a claim on land that some other person already owns outright. That's the situation Copey's worried about, and I find it hard to imagine that a civilized country like Canada would allow it. In Spanish Mexico hundreds of years ago, they allowed mining claims to be staked on other people's land, if the land owner wasn't actively mining it, but that's because the King of Spain was greedy for all the gold and silver he could get.
