My family has the mineral rights to our Montana properties, and they can be sold separately from the surface lands and do not automatically go to the landowner. When these properties were homesteaded, the mineral rights came with the original property titles.
My property in Wyoming has water rights that go back to about 1886. In this instance, the water rights did go with the surface property ownership. In other areas, you can sell your water rights separately from the land. It's always best to check the local and state laws because of the many differences between areas.
