Actually you can stake the mineral rights on any property in canada . parks and some other areas are not allowed to be staked . What you need is a mining license .Happens in other parts of the world too .
In the states it does get a bit more complicated , or less it depends on your point of view . Thinking you own your mineral rights is kind of like the concept that you own everything over your head .
