I hear what you're saying, especially since the sharks/lawyers are probably getting pretty hungry these days. You get into the same situation with building construction if you venture far from accepted practice, even if you think your design is better. In court, with a judge and jury of people who have never designed or built anything in their lives, you want to be able to say it "met all codes", was built "according to industry standards", was signed off by a licensed engineer, etc. Personally, I've never heard of anyone being sued over the alleged faultiness of his design for a modified car or truck (over-powered engines and jacked up suspension are at least as dangerous is poorly-improved brakes), but I don't live in a real sue-happy part of the country.

It seems to me that if your improved braking system was enough better than the stock system that it saved your life, regardless of what other damage happened because it wasn't perfect, it would still be better to be tried by twelve than carried by six.
