I know a man who was driving a loaded 5-ton military truck on a busy 2-lane road with a deep ditch on each side. A steady line of cars was coming towards him. Traffic was 50 mph in each direction. Suddenly some fool pulled out of the oncoming traffic in an attempt to pass. The driver of the truck tried to steer out of the way and wreck his truck in the ditch but it happened too fast. The car went into and under the truck, demolishing the truck's front axle and other other very heavy parts. They pressure-washed bits of the dead guy's face off of the bumper. The truck driver got some bruises and scrapes but no serious injury. I got to see what was left of the truck. He was trying to rebuild it.

After all that, even though it was 200% obvious whose fault it was, the state DOT impounded the truck and cited the driver for every little thing that was wrong with it. Then he got served with a civil suit by the dead guy's family, claiming of course that the truck was "defective" based on the state's citations. I think a couple of the brake shoes were worn past their spec limits and stuff like that.
