The person who owned it last is the person who gave the person trying to register it the bill of sale. What I meant is that nobody knows who had it before them, how it got on the farm, or whatever. Obviously, if they DO know who was the last registered owner, they should go to that person and buy it fair and square. It's certainly wrong to attempt to steal it in any way. If it's in the state DMV system as having once been registered to the bro-in-law, then they will have a "last known address" for him and somebody will probably have to send a certified letter to that address. If he doesn't reply to the letter, then I'd say it's fair game for a salvage title.
