I am no lawyer, but if your state is like Maryland (no fault) the insurance companies may use these "rules" as an excuse to get out of paying on situations like yours and what I mentioned in your original thread. THey all do it. Your lawyer should be able to tell you immediately if it is worth it to fight. If you do good luck and let us know.
