jack is right in nearly every respect. i own a company that sells images online, so i have more than a passing familiarity with copyright and trademark law.

there are however still works that are created that fall into public domain instantly...anything created by the us government or while in the employment of the us government for instance...nasa photos are an example. the pictures shot by soldiers at the prison in iraq are another.

there are a lot of legal issues still being settled that pertain to online copyright. deeplinking, inlining, framing, and other matters immediately come to the front. but in order for anyone to do anything other than what jack and norm are suggesting in this case will A) be extremely time consuming, and B) relatively expensive.

technically, this does appear to be a violation of copyright and trademark law as those laws sit on the books today. you could pass the situation on to dodge, ebay, etc., and possibly have them resolve the matter...but only if it fell into the right hands.

that being said, seems to me that i'd be willing to call it even if the guy gave me a clock.
