Ha, don't you like when a story starts with the opening "In Texas". Anyway in Texas it is perfectly legal to use deadly force (eg: shoot) on someone who is stealing your property, you don't actually have to be in a position where life or limb is in jeopardy.
A few years back a repo-man in Houston was retrieving a truck in the middle of the night when the property owner heard him and went out to investigate. The repo-man was killed on the spot by the house owner and even though the truck that was being reposessed did not belong to him he was acquitted on all counts. The reasoning dates back to the time when it was legal to shoot or hang (or both) horse thieves.
