This is a recent story in the Elko Daily before the trial, I didn't see anything about the outcome. You "scooped" 'em Russ, thanks.

Jarbidge case in federal court today

ELKO - Trial will begin today in federal court in Reno for John Eickhof of Wendell, Idaho, who was cited last September by U.S. Forest Service personnel for "resource damage" after he drove through the Jarbidge stream on South Canyon Road.

Eickhof was cited after he drove up South Canyon Road at Jarbidge in a 1952 Dodge Power Wagon and drove off the road and through the stream to visit Snowslide Gulch Trailhead.

Portions of the road have been washed out since a 1995 flood.

Elko attorney Grant Gerber will be Eickhof's counsel during the trial.

Gerber intends to call 12 people to testify, including nine Elko County residents.

Among those scheduled to give testimony in federal court are Assemblyman John Carpenter, R-Elko; Elko County Commissioner John Ellison; the county's road supervisor; Otis Tipton, Mike Lattin, and Elwood Mose.

Last October, Shovel Brigade President Demar Dahl told the Elko Daily Free Press that he believed the citation set a dangerous precedent.

"If there really was a resource destroyed, what does that mean for a deer hunter who shoots a deer and has to go off the beaten path to load it in his pickup?" Dahl said at the time. "What does that mean to a rancher who hauls salt out to his cows?"

In October, Mountain City Ranger Dan Dallas told the Free Press that Forest Service personnel have issued citations since 1977 to anyone caught causing unreasonable damage or disturbance to "the land, wildlife or vegetative resources."
